Florida vs. North Carolina LGBTQ+ Laws, Side by Side (2026)

North Carolina is better than Florida on some LGBTQ+ laws and weaker on others. As of September 2026, marriage is equal in both states, neither has a statewide LGBTQ+ nondiscrimination law, and trans adults have easier access to health care in North Carolina. The surprise for many South Florida couples: if your city or county protects you in housing today, you'll likely give that up here.

Laws and lawsuits in both states change month to month. Every status below carries a date, and I recheck this page at least every quarter. I've lived in Asheville since 2020, and I follow both states' laws closely. I'm a broker, not a lawyer, so treat this as a map and take your specific questions to an NC attorney.

People have written to me that they "want to feel accepted," and plenty ask for a gay agent before they ask about houses. I can only answer from my own life. I play volleyball here, and a regular group is an easy way to meet people. That's one man's experience, so come visit and see how it feels to you, then read the laws below with a clear eye.

Marriage and your family

Your marriage is valid in both states. The Supreme Court declined to revisit Obergefell on Nov. 10, 2025, when it turned down Kim Davis's petition. The federal Respect for Marriage Act (2022) requires states to recognize marriages validly performed in other states.

For couples, the practical items are paperwork. North Carolina lets married spouses hold a home as tenants by the entirety. Unmarried partners can't. For unmarried co-owners, survivorship generally has to be written into the deed, which is a question for your closing attorney. NC generally recognizes a valid out-of-state will and health care power of attorney, but hospitals tend to be more comfortable with NC forms. If you have children, NC law on second-parent adoption has a complicated history, and LGBTQ legal groups generally advise a court judgment of adoption or parentage. All of this goes on your list for an NC attorney, and I've gathered the questions in the couples' legal checklist.

Discrimination protections

State law. Neither state protects LGBTQ+ people from discrimination in private employment, housing or public accommodations.

Local law here. Two ordinances, both from April 2021:

  • City of Asheville: covers private employment (employers of any size) and public accommodations inside city limits. Sexual orientation and gender identity or expression are protected. Penalties are civil: $100 per violation, plus up to $100 a day.
  • Buncombe County: same protected classes, same two areas, but only in unincorporated Buncombe.

What those ordinances don't cover:

  • Housing. The city's own page and MAP's ordinance table show employment and public accommodations only. (One 2021 news story said Buncombe's covered housing. The official sources say otherwise.)
  • Towns with their own government. Weaverville, Black Mountain, Woodfin, Montreat and Biltmore Forest aren't covered by the county ordinance, and I found no ordinances of their own.
  • The rest of the mountains. MAP lists no local ordinances in Henderson, Haywood, Madison, Transylvania or Jackson counties. That includes Hendersonville, Brevard, Waynesville, Marshall and Sylva. Boone is the only other WNC town with one.

The enforcement record is thin. As of March 2022, Asheville had 5 complaints and Buncombe 17, with no violations found (Mountain Xpress). I haven't found newer data.

The federal floor.

  • Employment: Bostock (2020) still bars employers with 15+ workers from firing someone for being gay or transgender. On Jan. 22, 2026, the EEOC rescinded its harassment guidance, including the gender identity sections, so federal enforcement for trans workers is weaker.
  • Housing: HUD halted part of its gender identity rule in February 2025, and on Sept. 17, 2025 it withdrew the memo directing Fair Housing Act enforcement for sexual orientation and gender identity. HUD no longer affirmatively enforces those claims. Private lawsuits are still possible, but that area of law is unsettled.

What South Florida residents may give up

This is the part of the comparison people don't expect. Florida's state laws are harsher, but its local protections are much broader. MAP counts about 60% of Floridians as fully covered by local ordinances (employment, housing and public accommodations), compared with about 8% of North Carolinians. Broward, Miami-Dade and Palm Beach are among the Florida places with local housing coverage.

So a couple leaving Fort Lauderdale may be trading a harsher state for a better-scoring one, and a strong local ordinance for a thinner one. Both things are true.

If you're trans or nonbinary

Health care. North Carolina doesn't restrict gender-affirming care for adults. Florida's SB 254 still allows adult care, but only from a physician (not a nurse practitioner or PA), with consent signed in person on state forms. A federal judge struck down those limits in 2024, the 11th Circuit stayed that ruling, and as of April 14, 2026 there was no final appeals decision, so Florida's rules remain in effect. One caution here: NC's State Health Plan for state employees and teachers excludes transition care, and that exclusion stands after the Kadel case was dismissed in June 2026.

HB 805. North Carolina passed HB 805 over Gov. Stein's veto on July 29, 2025, and it took effect Jan. 1, 2026. It:

  • defines "sex" in state law as male or female, based on reproductive biology
  • still allows amending a birth certificate, but keeps the original and amended versions together as one record, which critics call forced outing
  • bans gender-affirming care in state prisons, bars state funds for minors' care, and sets a 10-year window to sue providers of minors' care
  • adds school library opt-outs and sex-at-birth rooming on overnight school trips

IDs. Florida stopped driver's license gender-marker changes by agency memo in January 2024. For help with names and markers here, Tranzmission and the Asheville-based Campaign for Southern Equality are the local resources, and CSE's Trans in the South guide lists affirming providers.

Restrooms. Florida's HB 1521 applies a sex-at-birth rule in government buildings, schools, jails and many state-licensed facilities, which can include some health care and assisted-living settings. That matters for older trans adults thinking about care later. North Carolina's HB142 still bars cities from regulating multi-occupancy restrooms, but a 2019 consent decree clarified that it doesn't by itself bar trans people from facilities matching their gender identity in covered state buildings.

Schools, grandkids and public life

  • Florida: HB 1557 limits classroom instruction on sexual orientation and gender identity (a 2024 settlement clarified that discussion, family photos and GSAs are allowed). HB 1069's school pronoun rule is enforceable after a July 2, 2025 appeals ruling.
  • North Carolina: SB 49 bars curriculum on gender identity and sexuality in K-4 and requires parent notice before a school changes a student's name or pronouns. HB 574 bars trans girls and women from girls' and women's teams. HB 808 bans gender-affirming care for minors, and the challenge to it was dismissed on June 19, 2026.
  • Drag and Pride: Florida's SB 1438 doesn't ban drag. It penalizes venues that admit minors to "adult live performances," and the full 11th Circuit upheld it on Aug. 4, 2026. Starting Jan. 1, 2027, Florida's HB 1001 bars cities and counties from funding DEI programs tied to sexual orientation or gender identity; private Pride events can still get permits. Blue Ridge Pride's festival happens in late September each year (Pack Square Park, Sept. 25-26, in 2026).
  • DEI in NC: the legislature overrode Gov. Stein's vetoes of three anti-DEI bills covering state agencies, K-12 and public universities (House override June 24, 2026). I haven't confirmed how they treat sexual orientation or gender identity.

The politics

Gov. Josh Stein (D) vetoes anti-LGBTQ bills, and his term runs through 2028. Overrides need three-fifths of members present and voting. Republicans hold 30 of 50 Senate seats, a supermajority, and 71 of 120 House seats, one short. Overrides have still passed when a Democrat crossed over or Democrats were absent: HB 805 in 2025 and the DEI bills in 2026. All 170 seats are on the Nov. 3, 2026 ballot, and I'll update this section after the results.

The straight talk

  • No state or local law in the Asheville area protects you in housing, and HUD has stepped back federally.
  • Local protection stops at the city or county line. Moving from Asheville city limits to Weaverville or Hendersonville changes what applies to you.
  • HB 805 is real. Trans friends and family should read it before deciding.
  • NC's governor can be overridden, and he has been, several times.
  • Florida's local protections are better than anything in western North Carolina. What you gain here is a better-scoring state (MAP), especially on health care for trans adults.
  • Asheville isn't among the NC cities rated in HRC's Municipal Equality Index (2021-2025 editions), so be wary of anyone quoting a score.

Questions people ask

Is our Florida marriage recognized in North Carolina? Yes. Same-sex marriage has been legal in NC since Oct. 10, 2014, and Obergefell applies nationally. The Supreme Court declined to revisit it in November 2025.

Does Asheville's ordinance protect us when we buy or rent a home? No. As of September 2026, the Asheville and Buncombe ordinances cover employment and public accommodations, not housing. And HUD no longer affirmatively enforces sexual orientation and gender identity claims under the Fair Housing Act.

Can trans adults get gender-affirming care in North Carolina? Yes. NC's restrictions apply to minors, not adults 18 and up. Campaign for Southern Equality has warned about clinic closures and insurance exclusions, including the State Health Plan exclusion, so coverage is worth confirming with your insurer and provider before you move.

Is North Carolina better than Florida for LGBTQ+ people? On state law, yes by MAP's scoring: NC 3.25 ("Low") vs Florida -6.5 ("Negative") out of 47, as of September 2026. On local protections, South Florida is ahead. Which matters more depends on your life, your health care and where you'd live.

Do the local protections apply in Black Mountain or Weaverville? Not as of September 2026. Buncombe's ordinance covers unincorporated areas only, and I found no ordinances adopted by those towns. Always check whether a specific address is in city limits, a town or the unincorporated county.
